On March 8, the Government of Québec adopted the Regulation respecting the terms governing the use of monitoring mechanisms by a user sheltered in a facility maintained by an institution operating a residential and long-term care centre (CHSLD).

This Regulation is part of the Act to combat maltreatment of seniors and other persons of full age in vulnerable situations. It aims to regulate the installation and use of surveillance mechanisms, whether hidden or not, by a resident or their representative in a CHSLD.

In particular, the Regulation determine the persons authorized to install and use the monitoring mechanisms, the rules relating to their installation and their use (e.g. what can or cannot be recorded, the duration of the recording periods, etc.), the rules for the use and preservation of images and recordings, and the obligations of institutions.
